On December 17, 2020, Representative David LaGrand (D) of the 75th District introduced FIVE House Bills to amend several Public Acts. These bills include HB 6529, HB 6530, HB 6531, HB 6532, and HB 6533.
HB 6529 and HB 6531 tie together. These bills both amend PA 451 of 1976, entitled the "Revised School Code".
House Bills 6529 and 6531 amend the grades when parents/guardians must submit exemptions for their children to attend public schools. Instead of a written statement being submitted beginning at Kindergarten and again at 7th grade, and any time a child changes school districts, the new requirement would be exemptions being submitted beginning at Kindergarten and again at grades 2, 5, and 7, and any time a child changes school districts.
House Bill 6529 also adds a requirement for
"the director of the department of health and human services, the board of a school district or intermediate school district or the board of directors of a public school academy shall ensure that each public school it operates complies with all of the following concerning public reporting of the immunization status of pupils:
(a) Provides all of the following to the parent or legal guardian of each pupil enrolled in the school by sending an electronic mail to the electronic mail address it has on record for the parent or legal guardian or, if it does not have an electronic mail address on record, by United States mail to the mailing address it has on record for the parent or legal guardian:
(i) Information concerning the immunization status of pupils enrolled in kindergarten or grade 2, 5, or 7 in the school, including at least the total number of pupils enrolled in each of those grades in the school, the total number of those pupils in each of those grades for whom the school has received a signed statement under subsection (1)(a) or (c), and the total number of those pupils in each of those grades for whom the school has received a waiver statement under subsection (1)(b).
(ii) For a school district or intermediate school district, information concerning the immunization status of pupils enrolled in kindergarten or grade 2, 5, or 7 in all of the schools operated by the school district or intermediate school district, including at least the total number of pupils enrolled in each of those grades in the school district or intermediate school district, the total number of those pupils in each of those grades for whom the school district or intermediate school district has received a signed statement under subsection (1)(a) or (c), and the total number of those pupils in each of those grades for whom the school district or intermediate school district has received a waiver statement under subsection (1)(b).
(b) Posts all of the information required under subdivision (a) on the school's public website, with a link from the homepage.
(c) Posts a paper notice containing all of the information required under subdivision (a) in the main reception area of the school in a location within the plain view of the public."
HB 6530, HB 6532, and HB 6533 all amend PA 368 of 1978, entitled the "Public Health Code".
House Bill 6530 adds a section to include,
"(1)...all staff members of a child care center, group child care home, or family child care home must be immunized by an authorized health professional, local health department, clinic, or other agency offering immunizations for diseases prescribed by the department of health and human services."
and
"...an individual required to be immunized under subsection (1) must provide proof of immunization to the child care center, group child care home, or family child care home at which he or she is employed and to the department of health and human services."
House Bill 6532 amends the types of forms used for medical contraindication exemptions and also adds the requirement for nonmedical exemptions to be on State-approved forms!
"The nonmedical immunization waiver form must be obtained in person from a local health department by the parent, guardian, or person in loco parentis of the child and, subject to this subsection, the nonmedical immunization waiver form must be signed by the parent, guardian, or person in loco parentis of the child and witnessed by a local health officer. Before witnessing the signature of a parent, guardian, or person in loco parentis of a child on the nonmedical immunization waiver form described in this section, the local health officer shall inform the parent, guardian, or person in loco parentis of the child on the risks of not receiving the vaccine being waived by the parent, guardian, or person in loco parentis of the child and the benefits of immunizations to the child and the community."
House Bill 6533 adds two sections by which,
"If a local health officer confirms or reasonably suspects that an individual attending school or a program of group residence, care, or camping has a communicable disease and that there is a risk of the spread of the communicable disease, or a local health officer confirms or reasonably suspects that there is a risk of the spread of a communicable disease within the community for which a vaccine is available, the local health officer may exclude from attendance any of the following individuals until the local health officer determines that there is likely no further risk of the spread of the communicable disease:
(a) An individual lacking a certificate described in section 9206 indicating that the individual has been immunized for the communicable disease.
(b) An individual whom the local health officer otherwise considers susceptible to the communicable disease."
